BE COYOTE AWARE
A Coyote was spotted in the area recently by one of our homeowners.
Project Coyote's recommendation is to keep them wary of humans by acting large and using voice and gestures to indicate that they are unwelcome.

WINDY HILL FOREST HOMEOWNER’S ASSOCIATION (“WHFHA”)
MINUTES OF MARCH 9, 2013
MEETING
Minutes taken by Attorney Mark P.
Groves, acting secretary of the meeting.
The 2013 annual meeting was held March
9, 2013 at 1:30pm at Smyrna's Brawner Hall. This meeting was held
as part of written notice mailed on Feb. 26, 2013 to all 89 homes in
WHFHA and the required quorum of 9 homes was exceeded. Notice was
also published at the WHFHA entrance and on the windyhillforest.com
website.
It was moved, seconded and unanimously
resolved:
I. that the minutes of the March 3,
2012 annual meeting be approved, except that the standard annual dues
are not increasing to $120.
II. that the following persons be
elected by the membership to serve as the WHFHA Board of Directors:
Rochelle Martin, Susie David
Mark Groves, Carmine Lombardi
Sandy Vazquez, Maria Deramos
III. that for homeowners in
goodstanding, the annual dues be set at $100 with a $50 discount for
timely payment. Further, the Board shall have discretion to set
conditions for adjusting discounts in return for receiving current
contact information on home owners and home occupants.
IV. There was discussion on how the
covenants commenced in 1985 with an annual lawn maintenance free of
$216 which was subject to a 5% increase on the prior year amount.
After calculating the annual increases, the amount for 2013 is $847. Then there was discussion on how the covenants call for the
Association to maintain lawns and that the Board's policy has been to
allow homeowners care for their own lawns. It was resolved that
the Board has discretion to refuse that privilege on a case by case
basis to homeowners who do not care for their lawns or who fail to
perform as required under the covenants and policies of the
Association.
Various discussion of subdivision
matters occurred but no other resolutions were adopted.

Actually, the official assessment is $100 but the board is motivating timely payment by granting a discount for fees paid by May 31, 2012.

**In 1985 the Windy Hill Forest Homeowner’s Association recorded a declaration of covenants affecting its townhomes and their owners. It made the Association responsible for maintenance of common grounds and the lawns of each homeowner. That declaration included the right to assess $216 for lawn maintenance for 1985, and the right to annual increases of 5% of the prior year amount. The WHFHA Board of Directors has calculated an ongoing annual increase of 5% of the prior year amount from 1985 forward, and for 2012 the maximum that could be assessed is $766.
The Association’s policy is to entrust proper lawn maintenance to the Association members (which is consistent with Article IX of the WHFHA Bylaws - a copy is attached and is available at www.windyhillforest.com by clicking the “WHFHA documents” link). Instead of assessing $766 for lawn maintenance, the Association is assessing $100 per townhome for the entire 2012 year, and giving early payers a discount down to $50 per townhome. Resident Owners that get their payment in by May 31 can claim the discount. Landlords need to pay and to supply current contact info on themselves and their tenants by May 31. Otherwise the full $100 is due.
By paying the 2012 Assessment, owners are consenting to the Article IX bylaws, including the duty to take proper care of their lawns. If you are an owner that neglects lawncare or insists on having the Association care for your lawn, then please pay $766 to WHFHA right away, so lawn-care arrangements can be made.
Failing to pay has consequences. Members, please understand that the Association is no longer dormant. It is in good standing with the Georgia Secretary of State, it has had annual membership meetings at which a board of directors and officers were elected, and it has every right to make this assessment. A member that is delinquent in paying is subject to interest, late fees and attorney fees – those fees can add up to many hundreds of dollars and end up being filed as a lien on the member’s home. Further, the Association reserves the right to contact a delinquent member’s mortgage company to give them a chance to cure the delinquency before a lien is filed. Also, under the bylaws, a delinquent member delegates his voting rights to the Association. We look forward to your support and cooperation.

Etiquette for Dogs & Humans Both
Our community is blessed with many conscientious dog walkers who clean up after their pets. Keep in mind that there are 2 dog stations in the subdivision with clean up bags and a waste can:

These are suggested points of etiquette:
1. We are fortunate that the Windy Hill HOA IV community provides the grounds near the 1505 property. Let's go out of our way to keep that area clean.
2. Keep pets out of the flowers.
3. Be polite. People are on their honor with respect to dog etiquette, and to our credit the majority obliges. No one should be indignant, vulgar and outraged that a handful will fail to clean up after pets.
4. Please drive with care, speeding on Springleaf is both offensive and dangerous for the many walkers and pets.

The above place and time is set as WHFHA's 2012 annual meeting. The meeting is supposed to be in Room #5 on the second floor, but you may want to confirm this with the front desk on the day of the meeting. We will elect directors, discuss fee and repair policies and ongoing projects.
